As a service to the biomedical research community, The Jackson Laboratory will provide MICE solely for non-commercial, research purposes. Any recipient agrees that the MICE and their descendants, if any, will not be bred for sale nor distributed to any third parties outside the recipient's institution, and will be used solely for non-commercial research purposes. The original source of the MICE is the J. David Gladstone Institute (INSTITUTION).

THESE MICE ARE EXPERIMENTAL IN NATURE JACKSON AND INSTITUTION MAKE NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTY OF NON-INFRINGEMENT OF ANY PATENT, TRADEMARK, OR OTHER INTELLECTUAL PROPERTY RIGHTS.

In no event shall JACKSON and INSTITUTION be liable for any use of the MICE by Recipient, and Recipient hereby agrees to defend, indemnify and hold JACKSON and INSTITUTION, their representatives including but no limited to present and former regents, trustee, officers, agents, faculty, employees, and students, harmless from any loss, claim, damage, liability and /or expenses (including reasonable attorneys' fees) in connection with any and all suits, investigations, claims or demands of Third Parties which may arise or occur from Recipients use, storage and disposal of the MICE. Acceptance of the MICE shall be deemed agreement by Recipient to these terms.
