NOTICE TO RECIPIENT OF STRAIN(S) Use of MICE by companies or for-profit entities requires a
license from Contact for license inquiries:
Commercial Purpose means the use of the MICE by any organization, including Recipient to perform contract research to produce or manufacture products for general sale, or to conduct research activities that result in sale, lease, license or transfer of the MICE to a for-profit organization. However, industrially sponsored academic research shall not be considered a use of the MICE for Commercial Purposes per se unless any of the above conditions to this definition are met. As a service to the biomedical research community, The Jackson Laboratory ("TJL") provides mice to Recipient solely for noncommercial research purposes and not for any Commercial Purpose except with the prior written consent of UTRF. Recipient agrees that the MICE and their descendants, if any, will not be bred for sale nor distributed to any third parties outside the recipient's institution, and will be used solely for noncommercial research purposes. The original source of the MICE is University of Tennessee Health Science Center (“INSTITUTION�). THESE MICE ARE
EXPERIMENTAL IN NATURE AND TJL MAKES NO REPRESENTATION AND EXTENDS NO
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY
WARRANTY OF NON-INFRINGEMENT OF ANY PATENT, TRADEMARK, OR OTHER INTELLECTUAL
PROPERTY RIGHTS. In no event shall TJL, INSTITUTION or UTRF be liable for any use
of the MICE, and recipient hereby agrees to defend, indemnify and hold TJL,
INSTITUTION and UTRF harmless from any loss, claim, damage, or liability which
may arise from Recipient's use, storage and disposal of the MICE. |
